THE JUDGE ESSENTIALLY SAYING THIS COMES DOWN TO TIMING THE CALENDAR AND A UNIQUE SET OF CIRCUMSTANCES. THE REPUBLICAN NOMINEE FOR PRESIDENT FACES FOUR YEARS BEHIND BARS. BUT RIGHT NOW, HE WON'T BE SENTENCED TO ANYTHING UNTIL AFTER THE ELECTION. IN MAY, A JURY UNANIMOUSLY FOUND DONALD TRUMP GUILTY ON 34 COUNTS OF FALSIFYING BUSINESS DOCUMENTS RELATED TO MONEY. HE PAID A ACTRESS FOR HER SILENCE. BUT TODAY, JUDGE JUAN MERCHAN ISSUED A RULING SAYING HE'S DELAYING TRUMP'S SENTENCING. AGAIN. THIS TIME UNTIL NOVEMBER 26TH, TO AVOID THE POTENTIAL POLITICALLY PREJUDICIAL IMPACT THAT A PUBLIC SENTENCING COULD HAVE ON HIM AND HIS PROSPECTS IN THE UPCOMING ELECTION. >> I WOULD DESCRIBE IT AS A WIN FOR TRUMP AND COINCIDENTALLY, A WIN FOR THE SYSTEM. >> CRIMINAL DEFENSE ATTORNEY MICHAEL BACHNER SAYS THE JUDGE'S DELAY MAKES SENSE BECAUSE IT AVOIDS ANY IMPROPRIETY. >> JUDGE MERCHAN WENT OUT OF HIS WAY TO STATE THAT THE REASON I'M DOING THIS ADJOURNMENT IS TO SHOW THAT WE ARE AN INDEPENDENT FUNCTION. TRUMP. >> TRUMP'S LEGAL TEAM IS ALSO TRYING TO GET THE VERDICT SET ASIDE ALTOGETHER, CITING THE SUPREME COURT'S NEW RULING THAT ENTITLES A PRESIDENT TO GREATER IMMUNITY FROM CRIMINAL PROSECUTION. MERCHAN IS DELAYING HIS RULING ON THAT AS WELL UNTIL AFTER THE ELECTION. AND THAT'S NOT ALL THAT HAPPENED IN COURT TODAY. TRUMP ATTENDED AN APPEALS HEARING ABOUT THE VERDICT IN THE E. JEAN CARROLL CASE. JURORS FOUND HIM LIABLE OF SEXUALLY ASSAULTING HER IN 1996 AND DEFAMING HER. TRUMP'S TEAM WANTS THE VERDICT TOSSED OUT BECAUSE OF WHAT THEY CALL INFLAMMATORY EVIDENCE, INCLUDING THE NOW INFAMOUS ACCESS HOLLYWOOD TAPE, IN WHICH HE TALKS ABOUT GRABBING WOMEN. AND EARLIER TODAY, TRUMP COMPLAINED ABOUT THE CASES AND THE JUDGES HE'S FACING. >> THESE CASES ARE DISGRACEFUL, JUDGE MERCHAN, JUDGE ENGORON AND JUDGE KAPLAN, ALL OF THEM HOSTILE AREAS AND VERY, VERY HOSTILE JUDGES.
