MANDY MURPHY. FIRST ON FOX. IT IS OFFICIAL AMENDMENT 3 WHICH WOULD GUARANTEE ABORTION RIGHTS AS PART OF THE MISSOURI CONSTITUTION. WE'LL BE ON THE NOVEMBER BALLOT. MISERIES HIGH COURT CAME DOWN WITH THAT DECISION THIS AFTERNOON, REVERSING A CIRCUIT COURT'S DECISION JUST HOURS BEFORE TONIGHT'S DEADLINE FOR BALLOTS TO START BEING PRINTED. FOX NEWSMAX STATE NOT JOINS US LIVE FROM OUTSIDE THE MISSOURI SUPREME COURT BUILDING IN JEFFERSON CITY. THE MAXX BOTH SIDES ARE REACTING PASSIONATELY THAT THIS DECISION. >> YEAH, MANDY, A HUGE DAY HERE IN JEFFERSON CITY. WE WERE HERE RIGHT AFTER THIS DECISION CAME DOWN. WE DID TALK TO PEOPLE ON BOTH SIDES OF THIS ISSUE. OPPONENTS SAY THEY'RE GOING TO KEEP FIGHTING THIS THING. BUT AGAIN, IT WILL BE ON THE NOVEMBER BALLOT. AND PROPONENTS FOR THAT. THEY CELEBRATED TODAY. THE HIGH COURT'S DECISION CAME DOWN JUST BEFORE 2.30, TUESDAY, IF PASSED BY VOTERS. THIS NOVEMBER AMENDMENT 3 WOULD ALLOW FOR ABORTIONS UP UNTIL AROUND 24 WEEKS INTO A WOMAN'S PREGNANCY. >> AND ALSO GRANT PROTECTION FOR OF THE REPRODUCTIVE HEALTH CARE LIKE IVF AND BIRTH CONTROL AS WELL AS GENDER AFFIRMING CARE. RIGHT NOW, MISSOURI HAS A NEAR TOTAL ABORTION BAN. IT'S BEEN A ROLLER COASTER RIDE UP UNTIL THIS POINT WITH AMENDMENT 3 FEATURING MULTIPLE LEGAL CHALLENGES ON FRIDAY. A COOL COUNTY JUDGE SIDED WITH THE ANTI-ABORTION GROUPS THAT FILED A LAWSUIT AGAINST IT. THEN ON MONDAY, SECRETARY OF STATE JAY ASHCROFT SAID HE WOULD REMOVE AMENDMENT 3 FROM THE BALLOT. BUT NOW THAT'S ALL OUT THE WINDOW. IT'S ON THE BALLOT AND BOTH SIDES ARE REACTING ABOUT AS YOU'D EXPECT. THE SUPREME COURT HAS RIGHTFULLY INSURED. MISSOURIANS WILL HAVE THE OPPORTUNITY TO ENSHRINE PROTECTIONS FOR REPRODUCTIVE FREEDOM IN OUR CONSTITUTION ON NOVEMBER. 5TH. >> MISSOURIANS OVERWHELMINGLY SUPPORT THE RIGHT TO MAKE PERSONAL DECISIONS ABOUT ABORTION, BIRTH CONTROL IN MISCARRIAGE, CARE, FREE FROM GOVERNMENT INTERFERENCE. MISSOURI VOTERS ARE BEING HOODWINKED INTO WHAT THIS AMENDMENT ACTUALLY MEANS. IT'S NOT JUST ABOUT ABORTION. IT WAS ALL ABOUT. >> CIRCUMVENTING MISSOURI LAW, GETTING RID OF ALL THE PROTECTIONS THAT WE HAVE FOUGHT FOR FOR 50 YEARS. >> A LOT OF PASSION OUTSIDE OF THE COURTROOM THIS AFTERNOON. OUR FOX FOUR'S KELLY BUILT HERE. WILL SHE WAS INSIDE OF THE COURTROOM. SHE BRINGS US THE BIG MOMENTS FROM THIS MORNING. >> RIGHT NOW, THE PROCEDURE IS ILLEGAL IN MISSOURI WITH LIMITED EXCEPTIONS, MISSOURIANS FOR CONSTITUTIONAL FREEDOM IS THE CAMPAIGN BEHIND AMENDMENT 3. THIS COURT DECIDING TO KEEP US ON THE BALLOT IS WHAT PROTECT MISSOURI VOTERS GIVE THE VOTERS THE OPPORTUNITY VOTE. THAT'S SIMPLY WHAT WE'RE ASKING FOR. THE ORGANIZATION GATHERED MORE THAN 300,000 SIGNATURES ACROSS THE STATE IN ORDER TO QUALIFY FOR THE BALLOT. IT WOULD ESTABLISH THE CONSTITUTIONAL RIGHT TO AN ABORTION UP UNTIL FETAL VIABILITY AND GRANT PROTECTIONS FOR OTHER REPRODUCTIVE HEALTH CARE LIKE IVF AND BIRTH CONTROL AS WELL AS GENDER AFFIRMING CARE. IT WOULD ALSO PROTECT MEDICAL PROFESSIONALS FROM PROSECUTION. BUT SOME PROTESTERS AGAINST THE AMENDMENT. WE'RE OUTSIDE THE COURT TUESDAY MORNING AND SAID THEY BELIEVE IT'S WRONG FOR MISSOURI, WHICH DO HARM TO A BABY OR ANYBODY WE SHOULD TAKE CARE OF OUR. >> IN MEANS THAT GOD MADE LAST MONTH, A GROUP OF LAWMAKERS AND ACTIVISTS AGAINST AMENDMENT 3 STUDENTS ARE E SECRETARY OF STATE JAY ASHCROFT ACCUSING HIM OF WRONGLY CERTIFYING THE BALLOT LATE FRIDAY EVENING, CO COUNTY CIRCUIT JUDGE CHRISTOPHER LIMBAUGH RULED IN FAVOR OF THE ANTI-ABORTION GROUPS SAYING IT FAILED TO LIST WHAT EXISTING MISSOURI LAWS WOULD BE REPEALED AND PASSED AN APPEAL. GOT IT TO THE SUPREME COURT ON TUESDAY. AND A LOT OF MOVING PARTS LEADING UP TO TODAY. BUT THE BIG TECH TAKEAWAYS, THAT AMENDMENT 3 WILL BE ON THE BALLOT.
