Karen Read TRIAL DAY 20 (summary)

on today's video we'll be hearing testimony from Ashley valer Christina Hanley and Trooper Yuri buin so let's get into [Music] it hello everybody Welcome Back To Late Night review today in the trial Ashley Viller was questioned by Mr lowy extensively about how she goes about putting the pieces of plastic together in her puzzle likee fashion to create whatever it is she's creating with these pieces we went through that and that was pretty tedious however when Mr Yanti questioned her about some of the pieces particularly p7- 17 from an orange shirt and 7-18 from a gray long sleeve shirt in that that she was not the one who removed these pieces of plastic from these objects they were removed previously by somebody else and then sent to her this particular evidence was marked separate from the original pieces that she had received as evidence even though it was marked separate from the rest of the pieces she never at any point saw the clothing these particular pieces of plastic were removed from and she never witnessed the person who removed the debris from the clothing how this is done usually I don't know it is quite alarming to me that she wasn't the one that removed these pieces that Mark difference sent to her separately she marked on on her conclusion that these were from the pieces from the shirt which is misleading as evidence So based off of Ashley's lab's chain of custody of evidence they don't know who had the evidence or how long they had it the chain only starts when it's accepted by them so there's several pieces of evidence bags we'll take a look at here item 7-8 this evidence bag had 14 pieces of plastic in it red black and colorless and collected by Trooper deico this evidence was collected 5 days after the incident in January on February 11th 2022 Michael Proctor collected a bag of evidence and delivered it to the Massachusetts crime laboratory the interesting information about the difference between Michael Proctor's evidence and Trooper deo's evidence is Theo's pieces were of various sizes and some very very small as you can see Trooper Proctor's evidence had larger pieces in comparison to Trooper deos and the problem with that is they're saying that Michael Proctor found this large piece of evidence at the scene of the crime days later and that it was basically missed by all the other officers who were searching the area yet if you look at deo's evidence and there's like little pieces so it's just kind of hard to to believe that that large piece was not noticed that is quite strange and so that was pointed out during um cross-examination not only did he go and find this larger piece days after it was actually 2 weeks so like 13 days after the crime took place it was 13 days later the trooper Michael Proctor happened to be driving by that property and saw the piece there and actually there were even more pieces found by Trooper Proctor several days later after that so that would put it at 3 weeks later Trooper Michael Proctor found some more evidence there and of course he was the one that delivered these these three bags of evidence to be examined by the lab and it was it wasn't until after Michael Proctor delivered these bags of evidence that Miss Ashley was able to put together this puzzle so if it hadn't been for good old Mr Trooper Proctor she would have never been able to do that now I'm not saying that the break light wasn't hers so don't get that out of what I'm saying what I'm saying is it's just quite convenient that all these pieces keep getting found up to a month later but aside from that that's all we got out of her testimony and next on the stand is Christina Hanley Christina Hanley is a forensic scientist for the Massachusetts forensic crime lab and she's been there for 16 years she looked at the pieces of glass and the pieces of plastic under her microscope and she went ahead and checked out the pieces of evidence that being the blast and some of the plastic we're examined microscopically um no physical match was found with the piece of clear glass from item 714 um one of the pieces that I had labeled as piece E from 3-3 was found to be consistent in physical and instrumental properties with examined portions of the piece of clear glass from item 714 so accordingly um the examined portion of the piece of clear glass from item 3-3 um could have originated from the extion of the piece of clear glass from item look at this little chart I made here so we can understand and what is going on with all these pieces of evidence so let's take a look at this chart here in the top column we have all of the items so item 3-2 is going to consist of the glass from a cup item 3-3 is going to consist of a single piece of glass from a bumper which has a subcategories of a b c d and e item 7-12 is a glass recover CED by sergeant buenik and there were nine pieces A B C D E F and then it goes off to ikl the last column is item 7-14 and it's the glass recovered by Trooper Proctor and it's just one single piece this glass from the cup was compared to this piece of glass from the bumper and of course it's subcategories and it found that it did not match any of these pieces and then we go to the next column for 3-3 which is the single piece of glass from the bumper and E was analyzed using various methods including microscopy UV light and glass refractive index against the single piece of glass found at the scene by Trooper Proctor and it did match now what's interesting about this is when you get this piece from 7-14 recovered by Trooper Proctor this was analyzed against the cup ins 7-2 and it did not match and it was analyzed against the nine pieces here found by sergeant buin and it did not match any of them so the only piece that was found to match something was this piece that was found on the bumper of Karen's vehicle when it was in custody at the Sally part at the sally port when it was in custody by the Canton Police Department in the sally port and it was the only one that matched anything and that and this piece okay scratch all that so the only match that was found was by the piece that Trooper Proctor found and it matched the piece of subcategory E from the piece of glass found on the bumper of Karen's vehicle when the vehicle was in the possession of the Canton Police Department in the sallyport none of these other things matched these didn't match Sergeant buenik pieces that he found the glass from the cup didn't match the bumper the glass of the cup didn't match Sergeant buin nine pieces and the glass didn't match Trooper Proctor's piece and the only one that did match was the piece that Trooper Proctor found and it was matched to the subcategory E from this single piece of glass from the bumper this piece being the piece that was found on Karen's vehicle when her SUV was in the possession of the Canton Police Department in the sally port if you remember from the previous video this is the piece of glass that was on her bumper that traveled all over the city you can make what you want with that that ends her testimony and we go on to Trooper yui buenik so Mr buenik is an officer for the State Police of Massachusetts and he is the one who went to interview Jennifer MC Matt mccab and Brian Albert at the mcab home he said him and Trooper Proctor went together to the mcabe home in one vehicle uh we first spoke with Miss Jennifer mccab um we then spoke with Mr Matt mcab and then we spoke with Mr Brian Albert and with reference to each of those conversations uh were they done collectively or separately or how those interviews conducted each interview was conducted separately we first interviewed Miss Jennifer mccab uh with with request of Mr McCabe to uh give us privacy he proceeded upstairs once we were done with that interview Mr McCabe came downstairs and miss m uh Miss McCabe uh gave us the same courtesy and once the that interview was over Mr Brian Albert had arrived and we interviewed him briefly is that sort of the typical process of of how Le your unit conducts interviews with respect to civilians yes with cooperating civilians uh we typically advised them they were going to be schedule an interview we uh proceed to their location Jen said that that Brian was there while they're being interviewed so I'm not quite sure who is wrong here or whose memory was wrong here but that is what he's testifying to now in this point in the trial they did show or they did show pictures of John's body to the court however they did not show us so we can't analyze any of that Trooper buin said he was the one that interviewed Karen Reed at her parents' home uh judge Beverly she gave her warning as she usually does that before hearing this testimony from the officer you have to be shown by the Commonwealth that these alleged statements were in fact made by Karen so with that warning we will move forward he said that Karen told him that John and her got in a fight that morning of the 28th about what the kids were being fed for breakfast and he goes on to say that she told him allegedly that she did not take a beverage with her to the waterfall from uh CF McCarthy's cuz they are at this other bar before going to the waterfall they have been saying that Karen had taken glass with her like a drinking glass with her from CF McCarthy these and that everybody noticed it at the waterfall and she was hiding it in her jacket and laughing and everyone was like calling her like oh you're crazy that you're taking this this glass during officer buenik interview with her he I guess asked her about this glass and she said that she did not take a glass with her from CF McCarthy's to the waterfall and why is that even of relevance here it's because the pieces of glass that is being referenced to they claiming that this was that glass she allegedly told him that that her and John were at the waterfall bar for about an hour and that they left a 34 fair viiew and she dropped him off because she she said her stomach was hurting her and so she made some 3 point some turn and left she didn't actually watch him go into the house I'm thinking this Karen she must have a lot of stomach issues because you remember when she also was down in on vacation with John and all of his friends and family how she wanted her own room I'm thinking Karen might have a lot of stomach problems so I don't find that too hard to believe that maybe that's why she didn't stay was because her stomach was bothering her and he said after that is when they actually went ahead and seized Karen's cell phone and her vehicle and of course that's when the tow truck came loaded up her her vehicle and went ahead and transported it to the sallyport at the Canton Police Department and that was actually the end of trial day 20 so with that I will see you for trial day 21 bye
