[Music] what [Music] hello guys it's been a little while how's everybody been doing well something that I do um is watch other you know True Crime commentary and channels and there's a few that I really like one of them is the deception detective he's a he's an attorney and he's been trained in statement analysis and so he doesn't really do anything with body language he feels that what people's words are what they say is is a lot of times much more helpful than studying their their body body language uh Peter hayatt is another example of someone who analyzes statements he had quite a few videos on his channel up until recently um regarding Sebastian Rogers and the proud the proud foots um but he's got got some great work and there's a few others in the field that do really good work anyway the deception detective he has a um a forum that you can join it's only $5 a month and it's it's fun to be on there because there's other like-minded individuals talking about True Crime analyzing things and he also sells something called the deception deck and the deception Jack deck is 79 cards that go through um it's kind of like a study card where the answers on one side and then the other side is the the the statement or the question and basically if you study these it helps you to detect Lies when people are speaking and so I thought it would be fun to uh use some of these and analyze Jennifer McCabe's testimony and see what we find now just because you know this a disclaimer cler just because someone exhibits some of these things in their testimony does not mean that they are guilty of anything and it does not mean that they are liars but if there's a lot of these things in in a given statement or testimony you can put more weight onto that and have some more questions you could say regarding the regarding the person's uh testimony so let's just see what Jennifer McCabe's testimony is like here and if I spot something and I'm no expert by any means but I am trying to learn with this deck so I thought it would be fun to just do it do it online with everyone so let's just start here and this is Jennifer McCabe's testimony uh cross examination in the car carry trial I was wondering whose Jeep it was did you discuss that detail with your husband at any point not sure you're not sure might have I'm not sure if I said whose Jeep is that no I don't mean z i mean between then and now have you and Mr MC ever discussed where that jeep was your memories of where that jeep was possibly you're aware that he put the Jeep in the exact same place are you aware of that I am oh wait no excuse me repeat the question you're aware that he puts the Jeep in the exact same spot you just put the Jeep right in front of that mailbox I know he knows where the jeep was I'm not aware what he said in here does he know where the jeep was because you told him what to say about the Jeep absolutely not it's because we drove together in the car and I asked I possibly could have asked one a time I'm sorry I didn't mean to step on your words I that's okay you can continue she's a trip for here she's so uh condescending and it just it's it cracks me up honestly I I just can't with this lady all right so one of the cards um in the deception deck is when you're dealing with un uncooperative subjects okay and I would I would really call her an uncooperative subject because her entire testimony if you've watched it I think we can all agree it was contentious and she was a difficult uh witness on the stand particular specifically with the defense right um and so we'll call her an uncooperative subject for that it says the more emotional they feel the less command they have of language and you know we'll see that again in in another clip when she calls him uh what was it Proctor trooper and and that sort of thing but regardless when dealing with uncooperative subjects a key tactic is to increase their cognitive load the stress of lying combined with this increased mental demand can significantly disrupt a liar's thought process and so I think that's what Alan Jackson is doing here with her and she ended up messing up because he's just asking her a series of quick questions kind of boxing her into a corner and then um when the judge judge you know basically says okay can you can you you know did you say that or do you feel that way and she says yes I am you see her like very comfortably say that it was probably the truth but then she realizes wait a minute I can't say that and she flubs with her with her you know words and backs up and and tries to qualify it and so I I think that's it was deceptive right so some of the techniques that you can use when dealing with these types of subjects is surprise asking unexpected questions that someone fabricating a story is unlikely to have anticipated number two is detail probing for intricate details that are often omitted in a fabricated narrative and I think that's what he's doing here as well he's asking very detailed questions about that jeep a lot of fuss was made about Brian Higgins Jeep and I I think for a reason um I think Brian Higgins his arrival time his departure time his silly sweeping of the of the driveway and all that stuff I think it all plays a role in them trying to catch these people up in manua because their story is is not necessarily the truth um and then it says reversal requesting the subject to recount their story in reverse chronological order which he's not going to be able to necessarily do on the stand and speed demanding quick responses and imposing penalties for hesitation these methods can effectively imbalance a deceitful individual revealing potential inconsistencies in their account so now that we've read that let's just go back a little bit and see watch her do this obviously stuck out in your mind it did because I was wondering whose Jeep it was did you discuss that detail with your husband at any point not sure you're not sure might have I'm not sure if I said who Jeep is is that no I don't mean then I mean between then and now have you and Mr M ever discussed where that jeep was your memories where that jeep possibly you're aware that put the Jeep in the EXA same place you check are you aware of that I am oh wait no right there EXC me repeat the question you're aware that he puts the Jeep in the exact same spot you just put the Jeep right in front of thatx I know he knows where the jeep was I'm not aware what he said in here does he know where the jeep was because you told him what to say about the absolutely not it's because we drove together in the car and I asked I possibly could have asked one at a time please I'm sorry I didn't mean to step on your words I thought that's okay you can continue thank you appreciate that I don't think we got your answer though okay yeah I think Madam court reporter was asking for your answer repeat your answer to the question of did he know where the jeep was I did not need to tell Matt where the Jeep is was he knew because we were in the car together you disuss okay so here's another one of the cards and I think this is pretty interesting in terms of explanations right Liars tend to offer explanations for why things happened revealing their insecurity and expectation of disbelief in contrast honest individuals usually present facts straightforwardly allowing the truth to stand on its own if a story includes Superfluous explanations it might be a sign of deception and I think that's what we're seeing here at least in my opinion she's giving this answer like I I didn't need to tell him because he was in the car with me so she's like explaining the obvious right why are you explaining the obvious just say no just answer no it's it's really pretty straightforward and simple what is going on with all the extra detail so listen to it one more time so you can pick up what I'm saying here okay yeah I think Madam court reporter was asking for your answer can you repeat your answer to the question of did he know where the jeep was I did not need to tell Matt where the Jeep is was he knew because we were in the car together but you two disussed it when are you asking at any time between January 29th and today I'm sure we have yes um you were also interviewed by trer Proctor on January 29th 2022 correct yes and you were asked a series of open-ended questions what did you see where did you see correct yes have put any words in your mou no told you what to say at that time no you told TR Proctor that when you arrived at the scene after you got there you quote first observed the vehicle meaning Miss Reed's SUV parked on the street by the driveway facing the direction of chap correct can I do you have something I can look at to refresh my memory sure do you not have a memory exactly what we told well I know what I yes or no you need your memory refreshed I would like to see what the report says please yes paragraph three this is the face page you'll review that especially the highlighted portion let me know after you red it just read it to yourself do you have that uh is that refal recollection yes I know I told ask I'm so sorry to do this I don't mean to be rude see she's already starting to uh she's already starting to offer an explanation he hasn't even asked her a question other than has that refreshed your recollection and she is ready with an explanation because she is concerned about you know what question he might be getting at and she wants to get ahead of it and so um the it's the offering explanations when they're not asked right I'm just asking you does that or does that not refr regarding what you said to Tri proor on the 29th well I know what I said to D bror Trooper on the 29th I have to do it this way rules does that help you with your recollection of what you told tro I didn't tell tro I told Trooper Proctor the car was let's just stop there so once again I mean she's having trouble just speaking right and um he's asking her more intricate details maybe um an unexpected question and the stress is already there and and so the quote was the more emotional they feel the less command they have of language and you can see it right here she's literally tripping over her own words so you know in my opinion based on this um this Research into statement analysis this is an example of of uh deception that we see here again when I looked at the front door and was straight outside I can't quite get the answer I'm looking for the court is going to require me to ask this question again does that refresh your recollection yes or no as to what told I did not say this to tr Pro Proctor no does no okay may I approach yes so you did speak to trer Proctor on the 29th correct correct and trer Proctor asked you some very specific questions about where things were correct correct focus on Miss Reed's SUV didn't it asked you questions about where misss SUV if you can show me in the report just read so just off of what I just read is that what you're going off off of yes so another um another thing here um I I do I should make this disclaimer um in terms of motivations right assessing motivation so even if I'm correct right and I'm I'm a young student in this statement analysis so I'm sure um someone like deception detective you know might watch this and say that I'm incorrect or something and I would I would gladly defer to them because I'm not I haven't studied this obviously not even close to it extens ly but I do want to say um a couple things here well firstly assessing motivation so even if we can assume that these things are deception that she's displaying deception in this statement in her testimony we still don't know what the motivation is right it could be because um she's hiding something but it doesn't mean that she is part of a murder conspiracy okay so I think it's important to um you know to to point that out because again I'm not I'm not saying that she is I'm just noting that that her testimony seems to be um deceitful and there's lots of uh ways that we can pick it apart and look at it that way but we don't know what her motivation is for the deceit right so that's important and so that's something that you know once you detect the deception finding out the motivation is is something you know more investigation would would be needed and then here I'm just going to mention that uh one of the other cards in the deck is a question with a question when someone Echoes your question or responds to an accusation with another question it can be a tactic to buy time for fabricating a deceptive answer also be cautious of questions that suggest a denial without explicitly stating one such as do you really think I did it this type of response often serves as a deflection avoiding a direct answer while appearing to address the accusation because what happens is and and we we'll notice this in some more of her testimony she'll question when she's asked a question she either repeats the question or she asks a clarifying question to Allan Jackson so much so that several times in the testimony he says I'm the one that get gets to ask questions right now miss McCabe right and so it's a delay tactic um often it's a delay tactic where they stall people stall theoretically to come up with an answer as to how they're going to respond to something which means they're fabricating something right because the truth you don't need any time you don't need to delay anything you just answer you just say yes or no you don't need to offer explanations or uh details that don't matter you just you just speak the truth right so I think that part's really uh interesting too and so we'll just back this up just a little bit so you can see it off of what I just read is that what you're going off off of yes I'm asking for your mem yes so my memory is exactly where the car was hold on so it's very important that both of you one person at a time speaks okay Madam court reporter has to do what you're both saying and she can't do it simultaneously so the best way to do that is um Miss mccab just let Council ask the question and then you answer and if takes a lot more time than we expect it to take it does okay so just go ahead Mr Jackson thank you I'll slow it down did you talk toor about the Su yes and he asked you questions about where it was situated outside correct yes and you told him that you first observed it parked on the street by the driveway facing the direction of Chapman correct I told him that when I looked out the front door the car was straight ahead and yes it was facing of Chapman you out a little the driveway correct that could have been his interpretation or an error on his part I see proor is wrong about what you said objection no I'll let him have it do you think he's wrong about what you said I 100% said it was straight out the front door okay next question please and during the of that conversation you never m m not once mentioned a several ton Jeep with a snow Clow text to did you I'm not sure if I did or not jaction do you think that will help you I'll take a look at it okay may I yes direct your attention once again to paragraph you had an opportunity I have yeah may I apprach on yes that looks like a report from troper Proctor of your interview correct correct that interview was taken on January 29th correct correct that interview was taken just a few hours not days or weeks hours after the events in question correct correct and you were asked what you saw what you deserve on a 34 on that morning correct I'm sorry the night before correct he asked specific questions about uh Miss Reed's vehicle okay and when you said where you remember this re's vehicle being you placed it exact spot where you're now saying there was a Jeep sow incorrect I never placed Miss Reed's car in the spot where Mr Higgins vehicle was so tro Proctor was taking notes about what you were saying he just got it you'd have to ask Trooper Proctor I will um and you never mentioned according to that report that one about a Jeep right I was I may never have been asked about a Jeep ah so if you weren't asked about a Jeep you were also weren't asked about mention that so I think that was also very um astute of Alan Jackson and I think that was another yet another sign of deception from her she's being interviewed think about this her supposed her alleged friend her this person that she loves John ke friend right um has has been found dead on the lawn and Trooper Proctor is questioning her about the event the evening before okay and uh Alan Jackson is sort of hammering her with a lot of different questions to get her flustered because he believes she's being deceptive as well and so um and she's getting flustered right and when he asks her about the discrepancy in her story about the Jeep being seen her answer is I may never have been asked about a Jeep well that doesn't sound like the answer you would give if your friend died and you're trying to figure out what happened I think we would all agree that you're going to want to be the most forthcoming you can be about whatever events led up to him ending up in the snow the next morning so the fact that she she uh even responds like that is just it's no bueno I mean I I think she thinks she's doing a great job but you know as as a public as a person in the public looking in it's like what do you mean he didn't ask you a specific question so you didn't comment on the jeep that was there why wouldn't you just comment on everything and tell the whole story well maybe she doesn't because she's being deceptive and this is another question um you know it's one of the things when they say you swear to tell the truth the whole truth and nothing but the truth right so you tell the truth and then the whole truth is don't omit anything right because omitting things is deceptive right so and people do tend to get comfortable with you know I shouldn't say that people are generally uncomfortable with lying right they're they're uncomfortable with lying and so the words that they choose to use are very important important and this is really fascinating um uh uh sub subsection of psychology to me and and that's why I wanted to break this down a little bit and so this card says recognizing missing information uh is there any point to which you would wish to draw my attention to the Curious incident of the dog in the nighttime the dog did nothing in the nighttime that was a curious incident remarked Sherlock h when analyzing statements is essential to pay close attention to what is not said Liars often omit crucial details whether to avoid incrimination or due to oversight to identify such omissions consider these factors avoidance is the speaker Sid stepping a topic that logically should have been covered indicating a possible deliberate Omission or gaps are there noticeable gaps or missing elements in their narrative suggesting that the story might be fabricated recognizing both kinds of omissions is vital in evaluating the truthfulness of a statement and I think here um she is sidest stepping a topic right um and then even saying you know I think it was a deliberate Omission okay and this I'm going to stop here for this statement analysis but if you guys enjoy this uh let me know and I'm happy to uh do some more I mean every EV pretty much everything she said saying here to me you're getting deception after deception her whole testimony was filled with deception um I was going to do Brian Higgin Higgins next if anybody's interested I'll do that um but lastly I just want to say you know in terms of the Karen Reed case it's interesting now to go back and look at some of the testimony um you know without having that like you know I don't know about you but I was kind of keyed up the first time I was watching it and really just hanging on every word and now you can go back and listen to it and it's very interesting to go back and listen and one of the things that is not making sense is Brian Higgins timeline the Higgins timeline makes no sense and the Jeep makes no sense and so uh that's why I focused on this part of the testimony because I wanted to see if I sort of nailed it down if there were signs of deception and I'm going to go and do that for everybody else's testimony around the Jeep in this uh in this trial if people are interested so if you liked it please like subscribe
