Why Tim Walz’s 2006 DUI Is a Bigger Story Than You Think

Introduction every single American red blue everywhere in between needs to be absolutely shaking in their boots terrified that a federal prosecutor who was anointed took a position that it is Tim Walz’s 2006 DUI a crime to contest an election we are Venezuela right now taxpayers you should be furious knowing that your money is being used unconstitutionally to Target the political opponent of Joe Biden and now kamla Harris this is the ins part about this whole thing Sean he's obviously speeding he's obviously drunk and then at his sentencing you saw the transcript I shot it over to you I read the entire TR it was the silliest thing ever in fact I'm actually surprised that the attorney tried this argument I don't know who he hired as an attorney but just for attorneys out there when your client hits the gas pedal after a cop turns around to try to to try to pull them over for speeding you don't go up in front of a judge and say listen he wasn't sure it was a cop and that's why he decided to ramp his speed up the argument here was that he was going only 50 over but then he started going even faster the problem is that with that is we have alcohol in the mix and clearly even if he did make this mistake that he thought that this wasn't a cop that's because you were drunk bro you were intoxicated yeah he actually in the transcript it actually says he thought the cop was chasing him because he didn't turn on his lights how understand that well no no here's here's here's the thing I mean this is this is what we're this is okay now in this country right I I didn't do I didn't do well at my job because you didn't train me I sped because you didn't properly identify yourself as a police officer and I thought you were trying to how many people do you think are just waiting to go chase Tim walls down on a road randomly in 1995 like that story is just it's just not credible it's not believable and here's the problem when you fundamentally see somebody like this who is afraid or not able to accept the consequences of their actions and just admit responsibility that's a character flaw like if I'm hiring somebody and this is what we're doing we're hiring the next Vice President of the United States if I'm hiring somebody and I see a character flaw like that the like ABS absolute absence of acceptance of responsibility that doesn't usually change in people you just have to reject that person outright period here's what I say to all those folks that think he's a breath of fresh air that's that mug again I love it I love it hey and I just want to say to our friends at Cactus ropes in Texas I'm loving the fact that you're liking our content man liking that liking that a lot and so I had I had to ask a question do I go without a hat today or do I go with this hat which is it's not a dad bod it's a father figure I I think that's fantastic um or or or do I do I show our friends out in Texas a little more love with cactus ropes I mean I think the first one gets us cancelled the second one's probably going to be a neutral so The shift away from cancel culture it's really up to you I I have I've I've never been cancelled before so I'm looking forward to it it's going to happen in fact that's what my daughter that's what my daughter told me on on the airplane yesterday when she found out we were doing this she said you're going to get canceled dad you say controversial things Bring it on Bring it on because you know what in all sincerity I think there's a shift right now away from this cancel culture because I think people on the other side are finally growing a pair and they're standing up and fighting back and saying you ain't canceling anybody you can try but the voices are getting louder the acknowledgment of conservative values is finding its way back and I think people in this country are finally starting to stand up and recognize that we have gone through now almost four years of pure Insanity pure Insanity did you see what's going on over in England and in Wales where if you publish and call anything a riot it is now a crime yeah yeah no that I'm actually really glad you brought that up um Story Time right I I grew up in the UK should be a seg Ron Story Time with Ron story story time with Ron no I like it um I'll need a special mug for that and then we'll need some music we'll have to we we'll have to let those podc guys over at Legacy I'm hearing Mr Rogers I'm hearing Mr Rogers theme song Story Time with Ron I think it's I think it's perfect we'll have to let those guys over at Legacy Media have been okay so story time I grew up in the UK spent a couple of years there in fact I played uh hockey there for a team called the Sully hle Blaze which is in the eahl it a great time had a lot of fun but I grew up way too quickly um over there uh when I was there it was uh you could already start to see The Divide so um there there was already quite a bit of a national sort of movement going on where pakistanis and other migrants who'd come into the country there was still quite a division a bit of division between the British and and them not with everybody but it was still there and and here's the problem as you started to pack people into that country the welfare state that is the United Kingdom started to to grow and then you have these people who are on the Dole or sort of part of the welfare state and taking all of the social services including socialized medicine and you see migrants getting packed in who aren't necessarily contributing to the same tax base that we're seeing now a lot of people may say hey no they definitely were contributing to the tax base I I don't I don't know but what I do know is that a lot of people who were taking advantage were part of the the welfare state that they had there were getting increasingly disgruntled because they weren't seeing the productivity from others and this is a simple hsian thing when we have a social contract I get socialized medicine um I follow the laws of our country um when we have a contract where people are invited in through a legal legal immigration process and then they're supposed to take part in our country and help it flourish we're all part of the same company right we all have to pick up an ore and we have to rot the boat forward but when a certain segment is not that creates a lot of disdain for that segment I'm not here to say whether or not not people weren't carrying their weight but I am here to say that when these Brits started to see housing being erected in certain areas for the sole purpose of housing migrants as opposed to disadvantaged Brits they start to feel that they are absolutely on the wrong end of the system and and you are seeing exactly what Thomas Hobbs back in the British Civil War predicted you're seeing people take up arms and Riot because the leaders decided not to govern and not to take care of their people all of their people right that's what it's really about it's not about taking care of a specific subset it's about taking care of all of the people with the decisions and and and they forgot about them why because their voice didn't really matter anymore on the world stage and and we were trying to pack as many migrants as we can in then the other thing that happened and I'll finish this really quickly is that they essentially suspended hius in England a lot lot of people didn't see this as as the DraStic move that it was but they they proposed and and offered to create 24hour Courts for rioter in the United Kingdom where if you were caught rioting you would be tried and essentially convicted within 24 hours that's like Bruce Willis I think that movie was called Citadel saying I'm the general I'm taking over New York and you know if we capture you because you've done a curfew violation now you get to be tried and and hung or whatever the hell is going to happen yeah I mean this is just um it's it's gone too far but we're you know we have seen this again over the last year and a half with the massive influx of illegals coming across the southern border and at first I found it comical that the governor of Texas and the governor of Florida were taking these migrants and shipping them to to these Sanctuary cities and all of a sudden now the mayor of New York is coming out and saying hey you can't do this man you you know we don't want them you know wait a minute what happened to being a sanctuary City because what started happening were the the minorities Within These cities right the the African-American Community was saying wait a minute we're already socially in economically repressed and now you're bringing these undocumented illegal aliens into these areas you're putting them into the housing that's supposed to be created for us for those who can't you know afford to be in anything else and now the crime is skyrocketing we don't even feel safe in our own neighborhoods anymore yeah and I mean so we're seeing exactly what transpired and you know all of these Sanctuary cities you saw it in DC you saw you know the mayor of DC came out and said this is unsustainable the mayor of New York came out and said this is unsustainable the mayor of Boston came out and said this is unsustainable but wait why Sean why isn't El Paso allowed to say that this is unsustainable well because it's racism okay because if somebody in Texas says something such as having an flux of 10 million or 11 million illegal aliens is unsustainable well you're just you're just a horrible person yeah you're you're a racist I mean it's it's Insanity I mean listen my family at the turn of the century immigrated to this country from around the world from different countries from Russia from Italy and when they came here they came here through Ellis Island they were processed they were documented and if they had any illnesses or you know sign of you know an illness they were put into isolation for a period of time you know and then they were released and they were able to go where they wanted to go and ultimately you know my my family uh you know settled in parts of New York in Boston and then at some point they came together my grandparents and they moved to South Florida and that's you know kind of the story but you know they didn't come here illegally and I think if you talk to the majority if not all of the people that have come to this country through ports of Entry they waited for years some of them waiting a DEC to be granted their Visa or to be granted their green card to be able to enter this country they're absolutely Furious they are furious with these people who have come across our Southern border illegally but here's the thing that concerns me more and and to anyone who listens to what I'm saying and they're like oh you're just you're you're a racist you're you know whatever you want to call me listen I'm talking common sense okay here's the thing 99 individuals on the terror watch list were captured and released into our country and our government cannot even tell us where the hell these people are and if you think that makes me feel warm and fuzzy right now especially with this potential new Administration talking about they're going to take our Second Amendment right away or Governor walls is going to make sure that the weapons he carried into war are going to be banned listen here's the last thing that I'll say Ron and I and I'm grateful that you've given me an opportunity to kind of vent for a minute absolutely here's the last thing that I'll say put aside the whole thing about the rank okay but it's now been shown because the Harris Administration quietly quietly made changes on their web page to his bio well if he wasn't a a compulsive liar okay and compulsive means you do it all the time okay the guy lied about his rank on his own website on the governor's website of Minnesota he lied about his rank when it came up in the debates for governor and he got called out on it in 2018 and he had to give somewhat of an apology it was kind of ridiculous yeah and then it's on the Harris website that's compulsive lying on a on a topic but beyond that he lied about the fact in 2006 during a debate that he actually was charged with a DUI and pled guilty to reckless driving which I don't think he understood at the time was actually a higher level crime than a firsttime DUI if you read the transl from the judge and finally the last thing that I'll say and the one that is the most egregious the most offensive to me forget about the fact that people were saying he abandoned his platoon because he knew they were going to war put put all that aside let's just let's just for argument sake let's give him the benefit of Doubt on this and say after 24 years he decided he had had enough he served country and in Air National Guard and he wanted to go on to something bigger and better for him and his family which was to get into politics okay I'm fine with that forget about why he did it he did it he he was entitled to it was 24 years okay but to come out and say I'm going to make certain that the weapons I carried into war are banned I'm sorry that is the most egregious thing I have ever heard because the only place he was ever deployed was over to Walz's military history Italy and maybe he carried an M16 over there maybe he carried you know an M4 I I I don't know what the Air National Guard gets I think they get the the crap of the barrel so he probably had an old M16 but I'm gonna guess he never saw War yeah um I'm sorry I'm I'm done I'm gonna pause no no I uh we we we'll get into Trump eventually but we can uh we can we can jump into this now because now you've got me fired up I think a lot of this Bears some explanation from a from a military man right from somebody who knows what's going on because I've seen a lot of people out there on the old internets saying no no he didn't lie about his rank so let's just lay this down once and for all I know a lot of people have gone into this territory but lies have moved faster than the truth in this current environment and so I think we've got a lot a lot of lies that are that that are moving forward here there is a difference between Rank and position or Billet in in the military he was a I believe sergeant major or he said that he was a sergeant major he was a command sergeant major command sergeant major he said he was a sergeant major though he said he retired as a sergeant major that would be an indication that he has the of Sergeant Major that means that he has gone up through all of the ranks of the military the National Guard he's reached the highest one and he has achieved the rank of Sergeant Major that is a very very difficult thing to achieve it is the highest enlisted rank that you can receive in the military it is a highly competitive position and you would have had to do everything perfect in order to get there I mean maybe you could be slightly imperfect but for the most part I I mean I know marine sergeant majors and their paper looks good they have fulfilled all of the positions all of the requirement all of the schooling and it is no joke that is probably one of the hardest and lowest paying professions that you could get into in terms of what you have to put into it these enlisted guys they are spending months years away from their family busting their butt in order to make sure that they they fulfill all of their obligations to get to that level I mean let's just look at what a Marine Corps drills Sergeant does which is one of the levels you would have had to pass I mean that is a very very difficult job so a sergeant major is a completely different thing than a master sergeant now I'm not saying everybody can be a master sergeant but this was the rank that walls ended up at Master Sergeant is much different instead of becoming that fourstar General very rare thing maybe you were a colonel I mean that's really the difference in terms of the number of Master sergeants versus Sergeant's major and you have to say sergeants major that's everybody's been making that mistake these last few weeks that's how you say it's major sergeant major yeah um like Attorneys General right we have that too uh but when he only achieves the rank of master sergeant and he stands up in front of people and says I was a sergeant major he is saying I held the rank of Sergeant Major he is not saying I was a command sergeant major and that is the huge distinction I actually think that that is a probably more egregious Than The Stolen Valor you know accusations about combat or War some of that stuff is pretty fuzzy like we know that he was puffing he's doing a Brian Williams all day we know that right but this is objectively clear you said you were a sergeant major you weren't a sergeant major period end of story you lied about rank that is a federal offense potential vice presidential candidate has committed a federal offense by lying about it this is not Swift voting this is keeping people honest about their sacrifice to the country because there are so many of us who sacrific for our country and we don't like people standing up with a microphone and trying to flex some credential of being a sergeant major I think this is way worse than John krey in his Swift boat story I I think this is way I mean yeah absolutely and and and you know folks again be independent readed independent sources do your own research like what Ron and I do I didn't read some BS story that was concocted to try to whitewash what transpired with Timothy walls in 1996 with his DUI we read it straight from the transcript in the court and we're going to give you that transcript that's it I we'll post it in the show notes I shot you that transcript Sean after I saw the comment we I said I said hey Sean is this true because we want to make sure it's true yeah and then uh I went and looked and found the official transcript that's the benefit of being a lawyer and being an investigator like you are um and and we've got to get to the bottom of it the rank issue the first thing that I did there are Publications that are put out by the military every time they promote people especially to higher ranks like that you can look through in the Marine Corps they call them Mar admins I for that and I found it so that I could verify that he did not hold the rank of Sergeant Major um I I I noticing and I've seen it on on the the social media channels lately where people won't even bother to read the article they will just share now a clip of the Google search result it's a clickbait that's all it is clickbait and and it's such BS and it was really funny because there was an interesting debate that took place on one of the social media platforms with you and I'm like a a an attack dog where I think one of my friends is being you know wrongfully attacked and I I I'm the I'm the kind of person that I don't come out and I don't scream and yell and and say all kinds of you know ridiculous things but I I responded to these individuals with pure facts no conjecture just pure facts and it was really funny to watch the difference in response to me versus the response to you which was hey thanks for the correction you're right my Google search was actually wrong however this person's a breath of fresh air well we'll get to what kind of fresh air he is because for me I feel like I need a gas mask to be around this guy because of all the crapy spewing but anyways you know I I want to talk about djt I want to talk about Trump derangement syndrome because it it's real and and and I think you know my position I love people who put policies out there that make sense I love Common Sense policies I I I am very much um a fiscal conservative I want smaller government I don't want them involved in every aspect of my life I want controlled budgets I want controlled spending I want common sense sense when it comes to social issues for the most part especially when it comes to loving who you want to love I'm all for it man there's enough hatred and anger in this world I don't care man seriously love who you want what you do in the privacy of your own home is your business as long as you're not trying to force me to engage in you know uh uh promoting that lifestyle as long as you're not trying to indoctrinate you know young children children into something that they have to allow their brains to form and to understand what it is that's being put in front of them other than that man listen love who you want do do what you want to do from a social standpoint you know as long as you know and and I always tell people how how I measure it is this your rights end when they infringe on mine that's that's kind of how I feel that's the rub right I mean a lot of people lead with the I want everybody to be able to live their life sure but all of these discussions every discussion that we have in this Society relates to the bumping up of two rights against each other or the bumping up of two individual liberties against each other and oftentimes it's multiple right when we get into arguments about what is considered hate speech and by the way common misconception I had to clear clarify this and I I try not to be a What is hate speech? sort of keyboard Warrior here but I care about the Constitution I care about you know the military these are topics that we really have to make sure that we keep people honest on because if people who know the truth don't say anything the lies propagate right and and they become um the the information that is now spewed but but let's go back to this um when we have a situation where these rights are bumping up against each other like in a hate speech context that's when the Supreme Court makes a test so we've had people out there saying Donald Trump's statements are hate speech okay is Hezbollah committing hate speech as well right what do we do about this hate speech and what is the test well the Supreme Court has made it very clear everybody uh who's been around for a few years remembers the Westboro Baptist Church case I can't remember the actual case name because I think the guy's name was Schneider Schneider um yeah but but but it was related to the westbo Baptist Church thank God for these people why now I'm saying this is a military man I was in the military bodies were coming home Somebody Like Larry Flint the founder of Hustler magazine we wouldn't have the people engaging in the type of extreme speech that is necessary to push the boundaries of the first amendment in order to test it okay so Westboro Baptist goes out in Pro test people get angry the case goes all the way to the Supreme Court can we restrict the speech of these people that we hate absolutely not the court has been very clear in near unanimous opinions westbo Baptist was like 81 I think 8 to1 yeah near unanimous opinions hate speech is not an exception you can say all the hate speech you want to in the United States we encourage it please feel free because if you don't want to listen to it go somewhere else right change the chel brother and sister are fighting go into a different room period that's it you have that right because you have freedom of movement as well now where do these rights bump up against each other in a sense that we really need to protect it if we're the government well it's in this one issue it's it's when your speech is akin to criminal conduct that is harmful to another person that's when it really becomes an issue so everybody uses this example fire in a movie theater now we I think that example probably came from the 1920s or something well we have spr we have sprinklers now we have like fire retardant materials we have lit exit signs I think if somebody yells fire in a movie theater these days um because alarm systems exist right people are gonna not really Stampede out but let's so so first we have to say Okay do we live in an environment where if we say fire in a movie theater it will cause a stampede it is surely to well we no longer have the sensitivities that they had back then about potential fires in public spaces because we've taken care of that so that example is already kind of trash but you would have to find an example where the speech is going to be so harmful that it will immediately cause injury damage to other people this is not Trump saying an election this is no longer fire in a movie theater because there's no indication that that would immediately cause any issues to anybody this is a situation where without the intervening criminal act of another person your words directly cause injury to somebody else I I think that there was a case and I haven't read this but um I remember it from from the news back in the day where somebody harassed somebody so hardcore that that person committed suicide and I think they were charged for that yeah there's some cyber bullying uh things that have transpired lately where uh a young lady uh was actually convicted uh because she told a young boy that the world would be better off without him so he should kill himself and the boy killed himself and she was criminally charged and I believe she was um uh uh convicted as well um but you know what about what about this okay with everything that's been going on over in Israel and in the Gaza and all of these Palestinian I'm going to call them rioter because that's what they are there may have been some peaceful protests at one point but what transpired at Columbia University was not a peaceful protest okay what has been going on in Washington DC with the defacement of federal property and and and and using these paints that are unbelievable but here's the thing that I would like to just point out very quickly about these young kids who are coming from these upper middle class or affluent families who think that they are social Warriors and that they are out there and they're chanting from the river to the sea but if you ask them what river you're talking about or what C they're talking about they have no clue but to me that is something that could potentially bring serious harm to people right because what the Palestinians are saying is we're going to eradicate all Jews from the River Jordan to the Mediterranean Sea that is dangerous hate speech that's not just that's not just conjecture that is how these people truly feel if you look at the Ayatollah in Iran his message is Crystal Clear I want to wipe Israel off of the face of the Earth if you look at what Palestinians and I'm not talking about the peaceful Palestinians who just want these wars to end they want this conflict to end and whether it's a two-state solution or whatever it is they want it to end and I don't blame them that they're there're but you have Hamas another Terror organization that will not rest until Israel no longer exists until there are no Jews walking the face of the Earth and I think it is absolutely shameful that we have allowed this anti-Semitism to resurface after what the world was subjected to under Adolf Hitler and and and and maybe this is a good place to transition in to you know talking about Donald Trump if you're ready but with the liberal media networks calling Donald Trump Hitler and and putting his face with the the little patch mustache and trying to make him look like Adolf Hitler this is absolute Insanity we should we should never ever want to see in this country what trans spired in Nazi Germany in the 1940s the extermination of millions millions of Jewish people put before firing squads used by their crazy Looney scientists as experiments put into gas Chambers baked alive women men children women raped treated like animals why would we ever want want this kind of speech in a country that's supposed to be a beacon on a hill for the rest of the world we have in certain respects digressed into a third world country and that's an embarrassment in my eyes well you know Sean I'm I'm just a lawyer so I don't I don't get to or have to have a political view on this I get to have the legal view that's and and that's that's my uh my safe haven when I go on national news as well and I'm given a controversial topic like this and I will tell you from a constitutional standpoint we have to protect the people who are saying from The River To The Sea just like we have to protect people who are using Other Extreme forms of speech because if we don't protect those people then we are making judgments about whether or not speech is Criminal based on how we feel the speech and not necessarily the immediate criminal impact of the speech now and I agree with you I agree with you but Ron let me ask you a question in the First Amendment right because there's no distinction between an individual or a group There's no distinction between it okay but to your point before hate speech is permissible under the First Amendment until it leads to criminal Behavior hate speech is is always all speech is protected hate speech has never been ex an exception however there is an exception to the First Amendment for that speech which is akin to a criminal action right by the individual causing the action so a conspiracy you and I agree to unlawfully distribute Drugs That's not free speech that is a conspiracy because we are using that speech to engage in criminal conduct but it's not speech that could cause somebody to engage in criminal conduct that's not an exception what to the to the first amendment that is absolutely protected by the First Amendment even if you say something as tenuous as if this election is stolen we are going to charge the capital protected speech why because it has to be right yeah that's it that's our first amendment listen God blessed the framers who had the foresight to create the the the amendments to the Constitution to take into consideration these these what if scenarios that could arise it's the most incredible document in my eyes that's non-religious that has ever been created I think the first amendment is really important in this context because we've seen the January 6th prosecution which was sort of an end around the first amendment when when Jack Smith decided to file the indictment he elected to go for essentially theories of fraud which the federal government has tried to expand significantly over the last 20 years but the Supreme Court has been attacking theories of fraud up and down uh criminal cases for for the last few years it's been uh quite quite incredible um but Jack Smith's Theory essentially is that Donald Trump Trump and his representations effectively attempted to interfere with the election and his speech in furtherance of that is not protected speech because it was in furtherance of this expanded fraudulent scheme to try to steal the election what he's trying to do there is attack free speech and everybody needs to understand this this is how this works remember we said that criminal speech is not free speech so what do we do we change the definition of a crime in order to make something sound criminal or a conspiracy and then we criminalize that speech because it was in furtherance of a crime so instead of I want to make sure this election was fair we say that saying that somebody tried to steal an election is a criminal conspiracy to defraud the American voters why because now anything you say in furtherance of protecting an elction action to ensure that it's free and fair has now essentially become some sort of criminal speech and this is why every single American red blue wherever you come from everywhere in between needs to be absolutely shaking in their boots terrified that a federal prosecutor who was anointed by the US attorney of the United States took a position that it is a crime to contest an election we are Venezuela right now we we not we're not in danger of becoming Venezuela there was a criminal indictment against a Man based on the idea that he tried to steal an election even though when power was to be transferred it was transferred that's aake crime that was created and and so we we know that that's probably not going to work and the Supreme Court is going to stop Jack Smith's prosecution it wasn't actually to get a sustainable conviction against Donald Trump the only reason that prosecution occurred is so that we could hold this guy up and impact the election of course that didn't happen but then we go to our people in the states fonnie Willis Alvin Bragg in New York and and we try to use the same hold them up scheme that Jack Smith was doing down there in New York and that's where we get these what 34 counts that's right false entry into a business record not even made by Donald Trump not even made by him now that testimony was the most important testimony of the entire case that the controller puts the information into the accounts and even thenone it's not criminal the these are the private books of a business a business held by Donald Trump right and the idea was that somehow a hush money payment and these facts have been you know everybody knows about these facts now so we don't need to spend too much time about it but but the allegation is that that paying a hush money payment is some some sort of criminal act no it's not so everybody should be scared about this as well because now settling a potential civil dispute while you're on your way to becoming a candidate or running for the Office of the President settle settling a potential civil dispute is is now no longer a legal expense it's no longer a business expense it's a hush money payment we've Weaponizing the justice system changed the name of it and now it becomes criminal that's that's what we do here um shameful unfortunate I never in my life imagined that we would see one political party weaponized the justice system to eliminate essentially eliminate the candidate opposing them I never thought that we would ever see that in this country we have for all intents and purposes turned into Russia and Putin I mean to a degree I mean you know Putin is you know uh allegedly having people murdered who are his political Rivals and I'm saying allegedly I I I don't want the KGB tracking me down uh and and eliminating me but well Sean how do you know how do you know I'm not KGB myself and I've been Undercover the entire time to wait for you to say that there's a Hitman outside your door right now be be careful man some people will take what you just did very seriously and they will now say that you are an agent of Russia um you know it's it's it's unbelievable to me the allegations that have been thrown at this man when in actuality the big guy and the clintons used pay for play I mean look at look at bisma okay look at um China and I and I think that's why the establishment is so scared and they are scared of Donald Trump they are they are absolutely scared because Donald Trump doesn't owe anyone a damn thing well that's that's for becoming president that's exactly it and and we we actually said this in uh the first episode that we did that the the one scary thing for everybody about Donald Trump Trump is the fact that he doesn't have all the strings attached and this is exactly why the coronation between Joe Biden and Camala Harris happened so that all of the people who had leveraged their power to get Joe Biden into office it would immediately transfer over to Camala Harris and of course that came from Obama you the the Obama Harris Biden sort of cabal if we want to call it that I'm certainly could I think Obama got forced into this Camala Harris I really do and and but here's the reason why Obama came out originally and would not endorse KLA Harris because he said we need somebody who can beat Donald Trump and it's not going to be someone who's standing up there saying what did you just fall out of a coconut tree I mean yeah it's it's just not okay so the problem that I think Obama had is that there were other forces at play which he didn't have enough time to coales all of them and put his team together so when you have Chuck Schumer you have Nancy Pelosi and you have the clintons who by the way if you if you now realize what the clintons have done they want their precious daughter Chelsea to be appointed the ambassador to the United Kingdom okay that's what they get in return if kamla becomes president okay that's their big ass because princess Chelsea has you know bigger bigger aspirations where her mother failed uh right she needs some some some chops on the international stage of course absolutely but but the UK is not really a great place to get them I mean you may want to go you may want to go at least to the UN but I I I think maybe that's where she's heading maybe she's trying to be ambassador to the United Nations we'll see but but you know the point the point here for me is simple I think Obama is so pissed off that he didn't get what he asked for which was an open convention so that he could have the person he wanted at the top of the ticket that he put his good friend Eric Holder in charge of vetting the vice president do you honestly believe as brilliant and Obama is brilant and we've talked about he is a politically brilliant Mastermind he he knows how to play the game of chess of politics do you honestly believe that if he really wanted this ticket to win he would put Tim Walls as the number two on the ticket knowing all of the warts that this guy has on him and the fact that he is coming from an Ultra leftwing Progressive uh uh State I mean there's no way Obama realizes and and and if you notice kamla Harris because of how left walls' uh positions are kamla is now trying to be the person coming back to moderation coming back to the center if you see but the thing that people aren't paying attention to is her saying things such as on day one why do you have to wait till day one we all know that Joe Biden is not the president of the United States we know this yeah why do you have to wait till day one you are the vice president of the United States in in in my estimation she is the president of the United States right now and she is the one who is capable of saying yes or no or making decisions why do you have to wait till day one to bring the cost of food down you know why she doesn't have a damn plan she doesn't understand economics okay she did you hear her explanation of Economics Bread's expensive gas is expensive we know it's a stress on people and people have to stress themselves further that's not how economics works yeah yeah we're going to lower prices is a statement I heard and that that's that's probably more Russian than my failed Russian accent uh I've ever heard right you does anybody know about vodka and pany hos in uh in the the then USSR I I don't know but if if you're not aware of how how that worked uh you may want to open up a history book and see what happens when we decide to manipulate prices uh individually as opposed to making sure that we have a healthy economy you know listen what whatever's going on with uh with Obama I mean he's pretty quiet this is all closed door stuff I I don't know and I think that I I would only be speculating if I jumped in to think what his motivations uh were but you back on this this Trump situation we've got some very interesting legal maneuvering that's happening right now we know that the Supreme Court granted official acts immunity we talked about that on the last episode we didn't really do a deep dive in it but if you if you haven't check that out go ahead and look at the last episode and then and then also if you give the opportunity click subscribe so you make sure you get the um directly to you yeah there's probably a button down there cck and survive make sure survive that is perfect click and survive we're gonna get that on a t-shirt Sean it's gonna have your face so interesting legal maneuvering Donald Trump's sentencing hearing has been pushed off to at least after the 18th surprise much closer to the election the reason why is that the Supreme Court granted Donald Trump immunity for official acts he's then using that immunity argument to say hey New York Court I should have immunity for the official acts over this and this is a kind of a stretched argument for even Donald Trump I'm I'm not I'm not going to take debate on this one I was trying to think if I'm his lawyer how am I going to try to use this immunity um ruling to benefit him in the New York case and that's going to be a very difficult thing to do because everybody knows that the actions that he was engaged happened prior to him becoming president but it does raise a very interesting issue if somebody is not given immunity for the things that they do during a campaign to become the president as an official action of the office then all we would have to do if we wanted to jam up a president is instead of looking at their official actions during the presidency you would look at their actions while campaigning and here's where this becomes a little bit tricky let's say we have a current president like Joe Biden who's campaigning and he commits a violation of the Hatch Act while he's campaigning and he's campaigning for another job as the president and for those people who don't know what the Hatch Act is it gets quite complicated but it really prevents you from using your official office as a campaign tool I see H Hatch Act violations from his press secretary on the regular but nobody does anything about it so let's say a candidate commits a hatch violation and they're currently the president they could be indicted under the Hatch Act which would cause them to potentially have to face some sort of criminal prosecution during their presidency because immunity is not granted this is what the court needs to be a bit concerned about if you say that you are not given immunity for the official acts of somebody campaigning for the Office of the President then current presidents who are campaigning are not given immunity for those and they could easily face prosecution by the next by the next president I want immunity for all presidents so that we don't end up in a lawfare society I think that it is a very good idea but I do think there needs to be limits the official act limit is is a fantastic place to draw the line because we don't want Justice soda myor out there saying if you hire SEAL Team Six to assassinate you know Barney the dinosaur which arguably I think should be an official use of government power he needed to be assassinated a long time ago I love how yours and my mind work and I didn't mean to step on what you were saying no it's okay I I love how yours in my mind work because I literally had pulled up s toay a's um um descent and I I I I want you to speak to this for just a moment because I I know you kind of you kind of tonged and cheeked it if you will but her direct quote was specifically she warned that the decision meant that a commanderin-chief could order US troops to murder an opponent then sidestep criminal prosecution she wrote again quote unquote the president orders the Navy's SEAL Team Six to assassinate a political rival immune organizes a military coup to hold on to power end quote I mean didn't the Democratic party just create a coup to throw Joe Biden off the ticket and essentially out of office I mean this yeah come on this is this is where it gets really dangerous because the act of falsely charging a person with these fake election interference crimes the that act is also an act of election interference think think about it this way and we're going to digress because we have to talk about this fiser versus United States the Supreme Court essentially overturned like 300 charging decisions made by Jack Smith 300 charging decisions where he used the sarbanes Oxley act a post Enron act that was designed to prevent you from shredding documents to avoid responsibility he used a catchall provision in that act which subjected people to a potential 20-year sentence because they um obstructed an official proceeding why not by shredding finan ancial documents like Bernie maid off or Enron but because they were involved in something that would have been considered relatively benign on the world stage when it comes to uh the actions of a protest right A lot of these people were just streaming into a public building not doing much else other than being there the rest of the people charge them with I don't know some sort of re destruction of property offense if you've got something like that whatever that's my trespassing but we're talking about a 20-year felony offense that is designed to prevent the obstruction of justice and they're saying that certifying this election is some some sort of official proceeding now the reason why I bring fiser up is because Jack Smith was essentially told by the Supreme Court shut the hell up there is no way in hell that this charge should be used against these people fer gets reversed the convictions of those other people need to be dealt with so how is it that a prosecutor goes to charge a few hundred people with this broad obstruction statute before Donald Trump gets charged with something why did it happen that way it's very clear what Jack Smith did he wanted hundreds of people to plead guilty and seek mercy of the court and blame Donald Trump for his behavior in saying something to cause them to go out and do it the those statements were encouraged at sentencing in these sorts of cases you know I'm sorry I got whipped up in the crowd and I heard Donald Trump and I got really excited and that's why I committed my crime I'm sorry judge and these judges were like eating that stuff up because they knew that that in Washington after a few hundred of those prosecutions then Donald Trump would be so hated and that it would be very clear that he was the cause and now they've got 300 witnesses to say Donald Trump made me do it right meanwhile Tim Walls is over here people are burning a thousand buildings in his his City and he charges 11 people with arson right I mean it just this is this is just Predictions for Trump’s legal future rampant election interference so Donald Trump's going to go to sentencing and you know I'll just throw down my prediction here Sean I don't think he's going to get jail time even from this judge because I I think that um this judge doesn't want to put himself in a position where he has to justify or or even cause the city to to deal with this um political nightmare that's about to happen if Donald Trump loses the election and I actually think that they've created such a power Powder Keg with their actions that throwing him in jail or otherwise restraining his Liberty is putting a match in that Powder Keg and and I think we've got a lot of dangerous things that are probably going to happen uh Nationwide if if he makes that decision and I don't think some lowly judge in New York wants to be responsible for this gulf of tonken incident that he's about to inspire here um because I I think that he he understands that there are consequences to even that blatant form of election interference that he's engaged in so what do we need to look out for here as Americans who are a little bit concerned about this government action we need to look out for those subtle restraints on Donald Trump's Liberty that are going to look like a completely normal response to this supposed criminal activity um and are going to restrain him a bit but not completely restrain him there may be continued gag orders and restraints on what he can say um there may be Pro probation conditions that require him to report and do certain things um there may be the addition of uh some sort of class Public Service counseling something like that that could be included uh that may be difficult for him there could be a long probationary period that really doesn't have too much in terms of teeth but it's just looking for some other action where he could then revoke Donald Trump's probation status he's going to try to keep a hook over Donald Trump so that this judge can keep his power over the president of the United States and potentially hail him back into court um he knows the New York Court of Appeals is going to dismiss this case so he's going to try to get as much as he can done during sentencing without sparking all of those problems that I just alluded to yeah I don't disagree with you at all but I think the other thing that's also really important to understand about Jack Smith is that the judge in Florida that dismissed the Canon uh yeah judge Canon who dismissed all of the uh uh indictments against Donald Trump brought by Jack Smith did So based on the lack of adherence to the Constitution right she said that he was the appointments Clause he was that's right the appointments Clause cuz he was not appointed by Congress which means his appointment was unconstitutional also the funds that were used to carry out this investigation were also unconstitutional taxpayers you should be furious with knowing that your money is being wasted is being used unconstitutionally to Target the iCal opponent of Joe Biden and now KLA Harris as the top of the ticket running you know the uh top of the ticket I mean this is unbelievable and and the problem The media’s role in all of this is I blame the media I blame the media for the ignorance and the lack of comprehension that the masses within our country possess and and I don't mean that as an insult because I think a lot of people believe that if they tune in to CNN or MSNBC or you know Fox News that what they're hearing is Gospel and the fact is it's not you're getting one side or the other's story um and and they're leaving out the substance they're leaving out the facts now I think Fox to some respects with people like Brett Bear and Shannon bream who are not opinion people I think they do a great job of delivering the news delivering the facts um without without bias yeah at least the most part you know if you're listening to a Sean Hannity or Tucker Carlson or uh uh uh what's her name the the blonde um you Megan Kelly no not Megan Kelly I love Megan Kelly by the way man she's such she's so cool um the other one uh uh who's uh Laura Laura Ingram yeah those are those are entertainers okay they are commentators they are opinion people Bill O'Reilly opinion people Joy Reed opinion person okay they're they're they're going to bias you you know the morning Joe they are going to give you their opinion they're going to give you bits and pieces of a story that make make it sound the way they want it to sound so that you'll believe in what they're feeding you yeah you know I missed the old days of the Walter con you know kronites where it was the news man the the um Brit Humes where it was delivering the news the facts but I'll tell you who ALS who also is really really good I love the guy Neil Cavuto I think Neil Cavuto calls BS at just the right times and I think he sticks to the facts I I really like him I'm I'm with you on Neil so I've been on Neil's show a whole bunch of times and you know he does it differently than than a lot of people which which I like uh first one thing you'll learn about and maybe this is inside baseball that I probably shouldn't share one thing you'll learn about Neil's show is that he he keeps it moving there are booking changes to his show moments before the show hours before the show based on what's on the news so that's really important because a guy like Tucker Carlson is going to make his agenda decisions very early on and sort of push forward with that agenda I want to do this but but Cavuto is a fast breaking news guy so what he would much rather do on his show is if something is no longer relevant or it doesn't need to be covered he's going to cut it off and so I'll you know let I'll be they'll let me know I'm not going to be on today because they've they've moved in a different direction with a different story it was annoying at first but I respect a hell out of it why because he's not looking to pound the same drum over and over again he's looking to respond to exactly what's happening but then every time he ask question whether it's about Sam bankman freed and FTX whether it's about Donald Trump all um he will take the position of the other side and ask me a question that requires me to answer it with some form of thought and legal knowledge a lot of other reporters that I talk to on national news spend a lot more time giving me a basic question or they do the agenda type talking where they say what they believe and then they essentially just asked me to agree with it that's that's the more frustrating version of it but Cavuto is spot on I just shout out to David asmin as well he often fills in Futo absolutely love him um and there's been a couple of other shows on Fox that I've been on that I've I've loved that having some time with them I will say that overall I do see Fox moving a little bit more to the center I I also might see CNN doing their version of that as well maybe we're going to start getting some balance we've obviously got MSNBC still out there doing absolutely wacky things yeah but back on the Trump situation um we've got we've got an interesting conundrum here this judge sitting in New York needs to decide Donald Trump's issue that he's raised related to immunity all of this is a matter of first impression because the Trump immunity decision just recently came out late in the Supreme Court term so he's going to have to write an opinion determining whether or not this case will go to sentence you rais some very good points about Judge Canon and the appointments Clause Alvin Bragg doesn't have the same issue but we also have the January 6th prosecution and chuin to contend with that people have sort of forgotten about right now but that's about to become the main Center Stage When Donald Trump gets probation in New York then every all eyes are going to be on chuckin and what she does does this get stayed for later or is going to be a situation where chuckin is able to continue with her case even against the sitting president in the United States she's going to have to decide the appointments Clause issue and so I'm so glad you brought it up because this is going to be the fundamental fight um for for for our country uh going forward here's why the appointments Clause issue is such a problem when we have a system of checks and balances our Justices are appointed we know this right and then they are confirmed the president doesn't get to choose who a supreme court justices this is why I find it quite odd when people say a president chose these justices no we still need confirmation remember Kavanaugh it was not easy right that's right it's a rigorous process so the Democratic process is playing out but when we have us attorneys and the attorney general that is a cabinet position of the executive office and so that person is appointed by the president and certainly would be confirmed but then all of the other prosecutors that work under the attorney general in the doj are essential H essentially hired employees of the doj then there are us attorneys United States attorneys in each federal district those people are appointed as well why do we do this why do we have um a doj US attorney who is appointed and then we also have the smaller us attorneys well this system started a long time ago and it's a great system those us attorneys are appointed to look out for the issues in their District so that they also have a seat of power in that area and they are appointed and confirmed now we have this sort of two-sided doj system where we've got us attorneys and the Attorney General does the Attorney General get to order a US attorney to do things not exactly us attorneys have their own power there's doj policy they probably shouldn't violate it but these individual us attorneys are responsible to Congress and they can be removed by Congress you know for certain types of actions they can't be unilaterally removed by the US by by the Attorney General by merri Garland in this case they can't be unilaterally removed so when you initiate a prosecution from the do J How the DOJ works level it can be initiated by the Attorney General but it has to take place in a district because you you can't just prosecute somebody in doj Attorney General Court you have to take it to a district and the US attorney is involved in that District so southern district of New York is where we would do a lot of these things you can also do that in Washington DC and sorry for the long explanation here but it's really important so Meritt Garland says I'm going to appoint Jack Smith to be the prosecutor here on this case I'm going to appoint him because I want to ensure that there is um some I don't know what would we say impartiality like that's the case I I don't understand how that ever follows Merrick Garland's going to appoint somebody to ensure that this person is impartial to the people that oppose Merrick Garland and Joe Biden an Appo Dee of Joe Biden is going to appoint somebody and then we have to look at the checks and balances on that appointment who gets to determine whether or not that person has any Authority or power and the limits and scope of that Authority and power is it Congress when did Congress vote on Jack Smith's appointment never they voted on every us attorney and they certainly would have had to you know vote on the cabinet positions but they never voted on Jack Smith when did Congress authorize the funds for all of this in investigative you know uh work uh January 6th cases that were done by the doj and also Donald Trump and every other uh appointment like that there was never any authorization of fund so one of the essential checks and balances of our system is the power of the purse everybody knows this Congress holds the power of the purse and they get to decide where money is spent the executive really doesn't have any money of their own other than what is specifically given by Congress people think judge Canon's opinion is controversial it is not controversial at all if we live in a system where an attorney general can appoint whomever they choose under the guise of impartiality to engage in a limitless exercise of prosecutorial Authority across the United States against any Target they choose using any policy they choose and using all of the money that they choose to use that is an egregious violation of our checks and balances on many fronts and it cuts Congress out and why did this happen because of some supposed idea that we need impartiality um but we're not going to go seek Authority from Congress it's shameful it's wrong judge Canon's opinion is correct judge chuin won't follow it this will go to the Supreme Court and it will forever change how these people are appointed and move forward uh my prediction January 6th case completely falls off and this is also going to cause a firestorm because other cases that were improperly appointed or where the doj was improperly appointed are also going to have problems sorry for the long-winded explanation Sean but honestly so complicated I think it's awesome and and I mean this is all part of the 88c count indictments against Donald Trump and I think what people need to understand is the difference between Jack Smith simply being put into place by the Attorney General Merck Garland versus Ken star who was actually confirmed by the United States Senate yeah and that's the big difference and you may remember Ken star from the Clinton impeachment you know what Sean sorry we we might as well just get Saul in here to talk about those days just gonna say sorry I beat you to it I'm sorry I swear I was just going to say because a very a mutual friend of both of ours and he's become a very good friend over the last couple of years i' I've been so blessed like to work with you on cases I've been blessed to work with Saul weisenberg uh let me tell you and and for those of you that don't know who Saul weisenberg is uh he is the attorney that led the impeachment effort against Bill Clinton and he was involved yeah I I I'm not sure exactly what his position was I think I think there was a lot going on there but he could definitely speak to what a proper appointment looks like and I think you know if if you all are interested in uh in having Saul jump in and and talk to you about that because I'm sure he could talk some inside baseball just drop a comment below and let us know I certainly want to hear if people are interested in going into that sort of depth on the appointments clause and then so you get the next episode hit hit subscribe for us absolutely but listen I I I think everything that you have said I agree with you um and not because I like you uh I agree with you because it makes sense because you're you're speaking about the law and while the law is supposed to make sense and it's supposed to you know it it's supposed to be you know blind and unbiased I I think you're going to see the cases carried forward but eventually it's going to wind up at the Supreme Court I think the Supreme Court is going to look at this and and look very carefully at the Constitution and I think even people like um Kagan and soday a are going to have to look at this and say this is a problem and if we're if we don't do what's constitutionally correct we are setting a precedent for the future that Democrats will now be in the same situation because I think ultimately Joe Biden could face criminal prosecution now you know they may come out and say he's a he's a kind old man who forgets things and and that would be a reason not to prosecute the guy but I mean yeah I know I'm sorry I give these little I give these little h on the now I want to open up the her report discussion I mean I did so many news hits on the her report and I read that whole thing and I broke it down and and I'm just I'm just sitting here absolutely astonished yeah that somebody can escape prosecu tion because of how how they're so mentally infirmed that they cannot comply with the law but that they are the executive who swore an oath to uphold and protect the law but they can't be held responsible to know what that law is and to actually follow it meanwhile we've got somebody facing prosecution for the exact same thing really quick Sean on the classified records thing here's the problem with classified records and here's why they pursued it against Trump it's lwh hanging fruit of course when you when you have people and you know this too when you have people involved in the dissemination or use of classified Material Handling classified material Sean is not an easy thing at all uh I was a prosecutor in the Marine courp did a ton of classified material investigations and let me tell you if I was indicting those people federally every single time there was a classified issue our leadership would have been completely destroyed uh it's a mess for example you sit down in a classified meeting and you take notes talk to General Flynn about those notes those are classified material and he was indicted for for that and and obviously um convicted for it but the concern here with classified material is that it's used as loow hanging fruit against somebody like Donald Trump in order to um be the first foray into charging somebody that an easy kind of objective defense that was the one that that was the kind of the first move towards charging him and once you've done that once adding on felonies in all of these other States became a little bit easier to do and and that's exactly why this entire approach was strategic across the country right they drew a bad judge but that was going to be that first Fay into this case very troubling stuff what we really need to do with classified material is I believe I I believe in what Rush has said he's the UFO guy who's been going around um I you know I'm not saying I believe necessarily in all these programs he's talking about but but fundamentally we have too many pieces of information classified that never should have been we have too much information siloed much of the classified material isn't really protecting any sort of secret it's just classified because of how it is I think that we just need to overhaul our our system of classified information and administratively hold people responsible that's my that's my
