BOTH SUBMITTED A PROPOSAL WITH VERY DIFFERENT VIEWS ON HOW THIS SHOULD PROCEED. THE SENSE FROM TODAY IS JUDGE TANYA CHUTKAN SEEMS TO BE LEADING BY SOMETHING PROPOSED BY THE PROSECUTION WITH THE BRIEF THE ISSUE OF PRESIDENTIAL IMMUNITY AND THEN IT WILL BE VERY COMPREHENSIVE. THE JUDGE FELT THIS WOULD ALSO GIVE THE DEFENSE TIME TO WORK ON THEIR ARGUMENTS. THEY WOULD NOT EVEN GET TO THE ISSUE OF PRESIDENTIAL IMMUNITY UNTIL DECEMBER. THIS IS REALLY THE ISSUE IN WHICH THE SUPREME COURT REMANDED THE CASE TO THE COURTROOM. IT IS ALSO NOTABLE ANY TIME A REFERENCE TO THE ELECTION CAME UP, SHE MADE IT VERY CLEAR THAT SHE IS NOT WORKING ON THE ELECTORAL CALENDAR AND THAT SHE IS A TRIAL JUDGE. SHE SAID IT WAS LIKELY THAT WE WILL GET A SCHEDULE BY THE END OF TODAY. >> VERY INTERESTING. THIS IS THE FIRST TIME THAT THE TRUMP TEAM AND SPECIAL COUNSEL JACK SMITH RETURN TO COURT SINCE THE MINUTE TWO RULING. CAVE-IN WHAT YOU ARE JUST SAYING ABOUT HOW THIS IS THE BIG ISSUE AT HAND, DID WE LEARN ANYTHING MORE ABOUT HOW THIS WOULD PLAY INTO THE CASE NOW? >> Reporter: IN A FEW WAYS . SHE WILL LOOK AT THE ARGUMENT AND DECIDE WHAT CAN BE RETAINED . ONE THING BROUGHT UP TODAY IS THE FACT FORMER VICE PRESIDENT MIKE PENCE WAS BROUGHT UP IN THE INDICTMENT AND THAT HE IS IMMUNIZED ON THE SUPREME COURT RULING THEN THEY SHOULD BE DISMISSED. THE JUDGE DID NOT AGREE AND WANTS TO SEE BRIEFING ON THE ISSUE. THE OTHER ASPECT THAT CAME INTO PLAY IS A CONCURRENCE FROM JUDGE CLARENCE THOMAS TALKING ABOUT THE APPOINTMENT OF SPECIAL COUNSEL JACK SMITH. THE DEFENSE IS TRYING TO USE THIS ARGUMENT TO GET THE CASE DISMISSED . >> NONE OF THIS HAS HIT TRUMP'S POLL NUMBERS.
